An architecture contract governs your entire relationship with your architect — from first sketch to project completion. Before you sign, make sure you understand these key provisions.
1. Scope of Services
The scope section defines exactly what the architect will and will not do. Look for clarity on which phases are included (schematic design, design development, construction documents, bidding, construction administration) and which are excluded. Vague scope language leads to disputes about additional fees.
2. Fee Structure and Payment Schedule
Is the fee a percentage, fixed amount, or hourly? What triggers additional fees? What is the payment schedule — monthly, by phase, or at milestones? Make sure you understand what you owe and when.
3. What Is Included in the Fee
Does the fee include structural engineer coordination? Civil engineering? Energy code calculations? Reimbursable expenses (printing, travel, permit fees)? Get a comprehensive list of what is in and what is extra.
4. Revision Policy
How many rounds of revisions are included in each phase? What constitutes a revision vs. a scope change? Most contracts include 2-3 revision rounds per phase and bill additional revisions hourly.
5. Ownership of Documents
Who owns the drawings? Standard AIA contracts give the architect ownership of instruments of service, with a license to the client for the specific project. If you want to own the drawings outright, negotiate this explicitly.
6. Termination Provisions
Under what circumstances can either party terminate the agreement? What fees are owed if you stop the project mid-design? Understand your financial exposure before you start.
7. Dispute Resolution
Most architecture contracts specify mediation before arbitration or litigation. Make sure the process is defined and that the jurisdiction is clear.
